Terms of use
This document is structured against industry-standard templates calibrated for an editorial publisher. It is not legal advice and must be reviewed by qualified counsel before public launch (see README.md §9 — Pre-launch checklist). Remove this banner once your attorney has signed off.
These Terms of Use ("Terms") govern your access to and use of the AIIncidentTracker website at aiincidenttracker.com and any related subdomains, APIs, newsletters, and services (collectively, the "Service"). The Service is operated by AI Incident Tracker, LLC ("we," "us," "our").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Not legal advice
The Service is an editorial research database. It is not legal advice. Nothing on the Service creates an attorney-client relationship. Do not rely on the Service as a substitute for the advice of qualified counsel licensed in your jurisdiction. Information about an incident, lawsuit, or law on the Service may be incomplete, outdated, or — despite our verification process — incorrect. We make no representation that any information is suitable for any particular purpose.
2. No warranty of accuracy
We make commercially reasonable efforts to verify every claim against primary sources and to label allegations as such. See our Methodology and Editorial standards for the process we follow. However, the Service is provided "as is" and "as available," without warranty of any kind, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy of content.
3. Editorial process and corrections
Every incident on the Service passes through automated language checks and human editorial review before publication. If you believe an entry contains a material factual error or misrepresents a named party, please submit a request through our removal & correction process or email editorial@aiincidenttracker.com. Our process is documented at /methodology and all material revisions are logged publicly at /corrections.
4. Acceptable use
You agree not to:
- Use the Service to harass, defame, or harm any person or entity.
- Use automated means (including but not limited to bots, scrapers, or AI crawlers) to access the Service in a manner that exceeds reasonable use, circumvents technical limits, or violates our
robots.txt. - Mirror, republish, or redistribute substantial portions of the Service's editorial content without prior written permission, except as permitted by Section 5 (License) and applicable open-data licenses linked at /data-attribution.
- Use the Service for any unlawful purpose or in violation of any applicable law.
- Attempt to interfere with the integrity or performance of the Service, or to gain unauthorized access to any portion of the Service.
- Use the Service to train or fine-tune AI models without prior written consent, except as permitted by applicable law.
5. License
Editorial content on the Service — including 200-word summaries, structured descriptions, severity classifications, taxonomy mappings, cross-references, and original analysis — is © AI Incident Tracker, LLC and is provided to you under a limited, revocable, non-exclusive, non-transferable license to view in a web browser or RSS reader for your personal, non-commercial use, subject to these Terms.
Source-licensed data imported from open databases (including AIID, AIAAIC, and OECD AIM) is governed by the licenses of those sources. Attribution requirements are displayed on each affected incident page and detailed at /data-attribution.
Press, researchers, and accredited media may request expanded licensing terms by contacting editorial@aiincidenttracker.com.
6. Subscriptions
Paid subscription tiers, when offered, will be made available with prices, billing cycles, and renewal terms disclosed on the Pro page at the time of purchase. You authorize us to charge your designated payment method for each billing cycle. You may cancel at any time from your account page; cancellation takes effect at the end of the then-current billing period and no refund is owed for the unused portion unless required by applicable law.
7. User submissions
If you submit an incident, correction, response, or other content for inclusion on the Service, you grant AI Incident Tracker, LLC a worldwide, non-exclusive, royalty-free license to use, edit, publish, and display that submission as part of the Service. You represent that you have the legal right to submit the content and that the submission does not violate the rights of any third party. We may, in our editorial discretion, accept, edit, or decline any submission.
8. DMCA
If you believe content on the Service infringes your copyright, please follow the procedure at /dmca. We respond promptly to valid notices.
9. Termination
We may suspend or terminate your access to the Service at any time for any reason, including for violation of these Terms. The provisions of Sections 1, 2, 5, 10, 11, 12, and 13 survive termination.
10. Limitation of liability
To the maximum extent permitted by applicable law, in no event will AI Incident Tracker, LLC or its officers, directors, employees, contractors, or agents be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including without limitation damages for lost profits, lost revenue, lost data, business interruption, or cost of substitute goods or services, arising out of or in connection with the Service or these Terms, whether based in contract, tort (including negligence), strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.
Our aggregate liability to you for any claims arising from or related to the Service or these Terms will not exceed the greater of (i) the amount you have paid to us in the twelve months preceding the event giving rise to the claim, or (ii) one hundred U.S. dollars ($100).
11. Indemnification
You agree to indemnify, defend, and hold harmless AI Incident Tracker, LLC and its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or related to (i) your breach of these Terms; (ii) your misuse of the Service; (iii) your violation of any law or the rights of any third party; or (iv) any content you submit to the Service.
12. Governing law and arbitration
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles.
Any dispute arising out of or related to these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, in English, in Wilmington, Delaware, before a single arbitrator. Judgment on the award may be entered in any court of competent jurisdiction. Either party may seek interim injunctive relief in court to protect intellectual-property rights or confidential information.
YOU AND AI INCIDENT TRACKER, LLC WAIVE ANY RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. Arbitration shall be on an individual basis. If this class-action waiver is found to be unenforceable, the arbitration agreement above shall be null and void with respect to that dispute and the dispute shall be litigated in the state or federal courts of Delaware.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated by updating the "Last updated" date above and, where appropriate, by notice on the Service or by email to subscribers. Continued use after the effective date constitutes acceptance.
